The purpose of this Policy is to explain, in a clear and transparent manner, what personal data may be collected through the Website, why it is collected, how it is processed, who may process it, and what rights users may exercise in relation to their personal data.

This Policy applies exclusively to this Website and does not apply to any third-party websites, platforms, or services that may be accessed through links or embedded content available on the Website.

2. Personal Data Collected and Purposes of Processing

The Website may collect and process the categories of personal data described below, depending on how users interact with the Website.

Comments

When visitors leave comments on the Website, the data entered in the comment form may be collected, together with the visitor’s IP address and browser user agent string, in order to help detect and prevent spam or abuse.

An anonymised string generated from the user’s email address, also known as a hash, may be provided to the Gravatar service to determine whether the user is using that service. The Gravatar privacy policy is available at: https://automattic.com/privacy/. After a comment has been approved, the user’s profile image, where applicable, may be publicly visible in the context of the comment.

Media

Users who upload images to the Website should avoid uploading images containing embedded location data, including EXIF GPS data. Visitors to the Website may be able to download and extract location data from images uploaded to the Website.

User Accounts and Orders

Where user accounts, checkout functions, or e-commerce features are available, the Website may process personal data necessary to manage registration, orders, payments, invoicing, customer support, shipping, returns, refunds, and fulfilment of legal, tax, accounting, and administrative obligations.

Such data may include, by way of example, name, surname, billing and shipping address, email address, telephone number, order details, payment information, and any other data provided by the user during the purchase or account registration process.

Contact Requests

When users contact the seller by email, telephone, contact form, or other communication channels, the data provided by the user may be processed in order to manage the request, provide assistance, respond to enquiries, and maintain related correspondence.

3. Cookies

The Website may use technical cookies and similar technologies that are necessary for the proper functioning of the Website and for the provision of services requested by users.

If users leave a comment on the Website, they may choose to save their name, email address, and website in cookies. These cookies are used for user convenience so that the same information does not need to be entered again when leaving another comment. These cookies may last for up to one year.

If a user has an account and logs into the Website, a temporary cookie may be set to determine whether the user’s browser accepts cookies. This cookie does not contain personal data and is deleted when the browser is closed.

When a user logs in, several cookies may be set to save login information and screen display preferences. Login cookies typically last for two days, while screen option cookies may last for one year. If the “Remember me” option is selected, the login may persist for up to two weeks. When the user logs out, login cookies are removed.

If a user edits or publishes an article, an additional cookie may be stored in the browser. This cookie does not include personal data and simply indicates the ID of the article that has just been edited. It expires after one day.

Where non-technical cookies, analytics cookies, profiling cookies, or third-party tracking tools are used, they should be activated only where legally permitted and, where required, after the user has provided valid consent through an appropriate cookie banner or consent management mechanism.

4. Embedded Content from Third-Party Websites

Articles, pages, or product content on the Website may include embedded content, such as videos, images, social media content, maps, articles, or other materials. Embedded content from third-party websites behaves in the same way as if the visitor had directly visited the third-party website.

These third-party websites may collect data about the user, use cookies, integrate additional third-party tracking tools, and monitor the user’s interaction with the embedded content, including tracking interactions where the user has an account and is logged into the relevant third-party website.

The Website owner is not responsible for the privacy practices, cookie practices, or content of third-party websites and services.

5. Legal Bases for Processing

Personal data may be processed on one or more of the following legal bases, depending on the specific purpose of processing:

  • performance of a contract or pre-contractual measures requested by the user, including order management, delivery, customer support, returns, and refunds;
  • compliance with legal obligations, including tax, accounting, administrative, consumer protection, and regulatory obligations;
  • legitimate interests pursued by the Data Controller, including Website security, fraud prevention, spam detection, service improvement, and protection of legal rights;
  • user consent, where required, including for certain non-essential cookies, marketing communications, or optional services.

6. Data Retention

If a visitor leaves a comment, the comment and its metadata may be retained indefinitely. This allows follow-up comments to be recognised and approved automatically instead of being held in a moderation queue.

For users who register on the Website, where registration is available, the Website stores the personal information provided in the user profile. Registered users may view, edit, or delete their personal information at any time, except for the username, which may not be changed. Website administrators may also view and edit such information.

Personal data relating to orders, payments, invoices, and accounting records may be retained for the period required by applicable law and for the time necessary to protect the rights of the Data Controller in the event of disputes or claims.

Personal data processed for customer support or contact requests will be retained for the time necessary to manage the request and, where applicable, to document the communication.

7. Disclosure and Transfer of Data

Personal data may be processed by authorised personnel and may be disclosed, where necessary, to external service providers involved in the operation of the Website and the provision of services, including hosting providers, IT service providers, payment service providers, shipping providers, accountants, legal or tax consultants, anti-spam providers, and other parties involved in order fulfilment or legal compliance.

Visitor comments may be checked through an automated spam detection service.

Where personal data is transferred outside the European Economic Area, the Data Controller will ensure that appropriate safeguards are adopted where required by applicable data protection legislation.

8. User Rights

Users may exercise the rights provided under applicable data protection legislation, including, where applicable, the right to:

  • obtain confirmation as to whether personal data concerning them is being processed;
  • access their personal data;
  • request rectification of inaccurate or incomplete data;
  • request erasure of personal data;
  • request restriction of processing;
  • object to processing;
  • receive personal data in a structured, commonly used, machine-readable format, where applicable;
  • withdraw consent at any time, where processing is based on consent, without affecting the lawfulness of processing carried out before withdrawal;
  • lodge a complaint with the competent data protection authority.

If a user has an account on the Website or has left comments, the user may request to receive an exported file containing the personal data held about them, including data provided by the user. The user may also request the deletion of personal data concerning them, except for data that must be retained for administrative, legal, tax, accounting, security, or other legally required purposes.

Requests may be sent to: dimatteotricot64@gmail.com.

9. Security Measures

The Data Controller adopts appropriate technical and organisational measures designed to protect personal data against unauthorised access, loss, misuse, disclosure, alteration, or destruction. However, no online transmission or storage system can be guaranteed to be completely secure.

10. Updates to this Policy

This Privacy and Cookie Policy may be updated from time to time to reflect changes in the Website, applicable legislation, or processing activities. Users are encouraged to review this page periodically.

Returns and Refunds Policy

Customer satisfaction is a priority. If you are not fully satisfied with your purchase, you may request a return in accordance with the conditions set out below and with applicable consumer protection legislation.

1. Right of Withdrawal

Consumers who purchase products online have the right to withdraw from the purchase contract within 14 days from the date on which they, or a third party appointed by them other than the carrier, physically receive the goods, unless an exception provided by applicable law applies.

To exercise the right of withdrawal, the customer must notify the seller of the decision to withdraw within the above 14-day period by sending an email to:

dimatteotricot64@gmail.com

To help process the request more quickly, the customer is invited to include the following information in the email:

  • order number;
  • customer name and contact details;
  • product to be returned;
  • reason for the return, where the customer wishes to provide it.

Providing a reason is not required in order to exercise the statutory right of withdrawal.

2. Return Conditions

Returned products must be sent back in the same condition in which they were received. In particular, products must be intact, unused, clean, complete with all labels and tags still attached, and, where applicable, returned in their original packaging.

The customer must return the product without undue delay and, in any case, within 14 days from the date on which the seller is informed of the customer’s decision to withdraw from the contract, unless otherwise agreed.

The product must be returned to the following address:

Di Matteo Tricot di Isabella Di Matteo
Via Ferrucci, 217
76123 Andria (BT), Italy

Customers are advised to use a traceable shipping service, as responsibility for the return shipment remains with the sender until delivery to the seller.

3. Products Excluded from Return

Certain products may be excluded from the right of withdrawal where provided by applicable law. This may include, by way of example, customised or made-to-measure products, products that are clearly personalised, sealed products that are not suitable for return for hygiene or health protection reasons and have been unsealed after delivery, or perishable goods.

Any exclusion from the right of withdrawal will apply only where permitted by applicable legislation and, where relevant, will be indicated before purchase.

4. Refunds

Once the returned product has been received and inspected, the seller will verify whether the return conditions have been met.

Where the return is accepted, the refund will be made using the same payment method used by the customer for the original purchase, unless the customer expressly agrees to a different refund method and provided that no additional costs are incurred by the customer as a result of such different method.

Refunds will be processed in accordance with the time limits provided by applicable consumer protection legislation. The seller may withhold the refund until the returned goods have been received or until the customer has provided proof of having returned the goods, whichever occurs first, where permitted by law.

Shipping costs and return costs will be handled in accordance with applicable law and the information provided to the customer at the time of purchase. Unless otherwise required by law or expressly stated, return shipping costs are borne by the customer.

5. Exchanges

Where available, the customer may request an exchange for another item instead of a refund. The exchange is subject to product availability and to the seller’s confirmation.

Once the customer has chosen between an exchange and a refund, the choice may not be changed unless otherwise agreed with the seller.

6. Defective or Damaged Products

If the product received is defective, damaged, or does not conform to the order, the customer must contact the seller as soon as possible at dimatteotricot64@gmail.com, providing photographs and a description of the issue.

Where the defect or non-conformity is confirmed, the seller will provide the remedies required by applicable law, which may include repair, replacement, price reduction, or refund, without additional costs for the customer where required by law.

7. Refusal of Delivery

The customer may not validly exercise the right of withdrawal by simply refusing delivery of the ordered goods without following the return procedure described above. Failure to accept delivery may result in additional costs, including storage or redelivery costs, where applicable.
